Commercial/Business Litigation, in its most basic sense, is a dispute over an agreement/contract involving money or other property between two companies or between a company and an individual. Specifically speaking, commercial/business litigation is the negotiation and eventual litigation of issues that come up when at least two entities are in a dispute over a contract or other agreement – whether the dispute be a debt owed from one to the other (i.e., collection proceedings); a dispute in translating and interpreting the terms and conditions of a contract and/or negotiating and drafting contracts between two entities. The types of commercial litigation cases that one may see are: breach of contract actions; disputes over insurance contracts (personal injury protection cases and property damage cases); actions involving debt collection (both if you are owed money and if you owe someone else money and they are suing to try to collect that money); construction disputes; damages/disputes involving fraud and deceptive trade practices; employer/employee disputes over an employment contract; a person or company’s interference with another’s contracts and/or business relationships; shareholder or partnership disputes; the formation and/or dissolution of corporations/companies; and construction disputes involving performance or services or payment for services.
